  • Formal Proceedings: If the dispute is not resolved within 90 days of submission, you or Provider Empowerment Alliance, LLC may bring a formal proceeding.
  • Arbitration Agreement: You and Provider Empowerment Alliance, LLC agree to resolve any claims relating to these Terms or the Services through final and binding arbitration, except as set forth under Exceptions to Agreement to Arbitrate below.
  • Arbitration Procedures: The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including any rules or policies addressing the treatment of consumer disputes.
  • Arbitration Location: Unless you and Provider Empowerment Alliance, LLC agree otherwise, the arbitration will be conducted in Temple, Texas.
  • Arbitration Fees: The payment of arbitration fees will be governed by the rules of the arbitration association.
  • Exceptions to Agreement to Arbitrate: Either you or Provider Empowerment Alliance, LLC may assert claims, if they qualify, in small claims court in Bell County, Texas.

No Class Actions

You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action.

Judicial Forum for Disputes

In the event that the agreement to arbitrate is found not to apply to you or your claim, you and Provider Empowerment Alliance, LLC agree that any judicial proceedings will be brought in the federal or state courts of Bell County, Texas and both parties consent to venue and personal jurisdiction there.
